Mode Mobile, LLC ("Mode Mobile," "we," "us," or "our") operates the Mode Earn App and related services (collectively, the "Services"). This Notice of Financial Incentive ("Notice") is provided pursuant to the California Consumer Privacy Act of 2020, as amended by the California Privacy Rights Act (collectively, "CCPA/CPRA"), and describes the financial incentive programs we offer in connection with the collection, retention, and use of your Personal Information.

The CCPA/CPRA defines a "financial incentive" as a program, benefit, or other offering related to the collection, retention, or sale of your Personal Information. The Mode Earn App is, by its nature, a financial incentive program: we reward you with Earn Points (which may be redeemed for cash, gift cards, or other rewards) in exchange for your participation in the Services and the Personal Information you provide and generate through that participation.

1. Description of the Financial Incentive Program
   The Mode Earn App is a rewarded mobile application through which users earn Earn Points by completing eligible activities, including:

● Signing up and creating an account (providing name, email address, phone number, and a unique account identifier);
● Completing your profile (optionally providing age, date of birth, gender, country or city, tastes and preferences, and other survey questions);
● Completing surveys and answering questions offered through the Services, which may include demographic, lifestyle, and consumer preference information;
● Installing and reaching milestones in third-party games and offers;
● Viewing or engaging with advertising and sponsored content;
● Using the Mode search feature;
● Engaging with music and media streaming features;
● Participating in friend referral activities; and
● Such other activities as Mode Mobile may offer from time to time.

Users may redeem accumulated Earn Points for cash payouts, gift cards, and other rewards through supported redemption methods, subject to the Terms of Service and applicable identity verification requirements.

2. Personal Information Collected in Connection With This Program
   In connection with the Mode Earn App program, we collect, retain, and use the following categories of Personal Information, as described more fully in our Privacy Policy:

● Identifiers (name, email address, hashed email identifier, phone number, IP address, device identifiers, mobile device ID, advertising identifiers, unique account identifier);
● Personal information listed in Cal. Civ. Code §1798.80(e) (name, telephone number, date of birth, gender);
● Protected classification characteristics (age, date of birth, gender — provided voluntarily);
● Commercial information (Earn Points earned and redeemed, rewards redemption history, activity completion data, payout records);
● Biometric data (facial scan / face map, with express consent, collected solely for identity verification at redemption);
● Internet and network activity (app interactions, advertising engagement, attribution data, browsing and search behavior within the Services);
● Approximate geolocation data (derived from IP address, device settings, and country code);
● Inferences drawn from the above; and
● Sensory data (audio, where applicable to specific features).

3. Why We Offer This Incentive
   We offer Earn Points because participation in the Mode Earn App generates data that is valuable to us and our partners for purposes including advertising, survey research, analytics, and audience intelligence. The Points we provide are reasonably related to the value we derive from your Personal Information and participation. The incentive is not designed to be so substantial as to be coercive, and participation in the Mode Earn App is entirely voluntary.

4. Estimated Value of Personal Information
   The CCPA/CPRA requires us to describe how we calculate the value of your Personal Information to our business in connection with this program. We determine the value of Personal Information collected through the Mode Earn App based on our reasonable, good-faith assessment of the following factors:

● The anticipated revenue generated from Personal Information, including revenue derived from advertising, survey partner payments, data licensing arrangements, and related commercial partnerships;
● The anticipated costs incurred in the collection, storage, processing, and use of Personal Information in connection with the operation of the Services;
● The aggregate amount of Earn Points paid out to users, which represents the direct economic benefit we provide in exchange for user participation and data; and
● Other relevant factors relating to the estimated value of such information to our business, including the value of user engagement and the commercial utility of the data categories we collect.

We do not assign a fixed per-user dollar value to Personal Information because that value varies materially based on individual activity levels, the categories of data provided, prevailing market rates for survey and advertising data, and other variable factors. We have determined in good faith that the Earn Points offered through the Mode Earn App are reasonably related to the value we derive from the Personal Information collected, and that the program is not designed to be coercive. We will update our methodology and this Notice as required by applicable law or as our business practices materially change.

5. How to Opt In
   Participation in the Mode Earn App is entirely voluntary and constitutes your opt-in to this financial incentive program. By downloading the app, creating an account, and using the Services, you opt into the Mode Mobile financial incentive program as described in this Notice.

Participation in specific data-collection features — such as biometric capture for identity verification — requires a separate, additional opt-in consent at the time that feature is used, and you may decline that feature without losing access to the core Services.

In some instances, you may have the opportunity to provide Personal Information on an ongoing basis in exchange for Earn Points, or other financial incentives on an ongoing basis, the amount or nature of which will be specified in each instance at the time the Personal Information is to be submitted. You can opt into each such incentive by submitting the applicable Personal Information at that time.

6. How to Withdraw (Opt Out)
   You may withdraw from the Mode Earn App financial incentive program at any time by deleting your account. You can request account deletion in the app (Settings → Account → Delete Account) or by contacting us at privacy@modemobile.com (Attn: California Privacy Rights).

You may also withdraw from any specific financial incentive on an ongoing basis by not submitting the applicable Personal Information, or by contacting us at privacy@modemobile.com; the method for withdrawal from any specific incentive will be explained at the time the Personal Information is to be submitted.

Upon account deletion:
● Any unredeemed Earn Points will be forfeited without compensation, as described in the Terms of Service.
● Your Personal Information will be deleted or anonymized in accordance with the retention schedule in our Privacy Policy.
● You will no longer participate in the Mode Earn App financial incentive program and will no longer receive Earn Points.

Withdrawing from this program does not affect any redemption you have already validly completed.

7. Non-Discrimination
   We will not discriminate against you for exercising your rights under the CCPA/CPRA, including your right to opt out of the sale or sharing of your Personal Information. However, because Earn Points are the core mechanism of the Services, and because the Services are funded by the value of the data generated through participation, we may be unable to offer some or all Earn Points-earning features to users who have opted out of the sale or sharing of their Personal Information. Any such limitation will be reasonably related to the value of the data to our business and will be disclosed to you at the time you exercise your opt-out right.
